Registers UK express trusts and certain non-UK trusts, and keeps the register up to date. Element names below follow the TRS online form, not a verbatim schema.
When this applies
- A UK express trust (and many non-UK trusts with UK links), whether or not it has a tax liability, must register under the 5MLD rules.
- Taxable trusts: register by 5 October after the tax year of first liability (or 31 January SA deadline for some taxes).
- Non-taxable trusts: register within 90 days of creation/becoming registrable; changes updated within 90 days.
- Annual confirmation/declaration that the register is up to date where the trust is taxable.
Structure (trust details → TRS submission)
1. Trust details: name, date created, type, governing country, residence
2. Settlor(s): name, DOB, NINO/passport, nationality, address
3. Trustee(s): lead trustee (contact), all trustees; individuals or
organisations (with UTR/CRN)
4. Beneficiaries: named individuals, classes, charities; nature of interest
5. Other parties: protector, other controlling persons
6. Assets (taxable trusts): asset types/values at registration
7. Tax details: trust UTR (taxable), tax liabilities (IT/CGT/IHT/SDLT)
8. Declaration by the lead trustee/agent
Data rules
- Identifiers — trust UTR (taxable trusts) and individual NINO/passport for settlor/trustees/beneficiaries; organisation UTR/CRN.
- Lead trustee — one nominated lead trustee acts as the main contact / makes the declaration.
- GBP values — asset values to whole pounds at the registration date (taxable trusts).
- Deadlines — taxable 5 October / 31 January as applicable; non-taxable and all changes within 90 days.
- Maintenance — keep details current; respond to data-discrepancy reports from relying parties.
